By accessing or using the Remote Car Wash Manager service ("Service") operated by MBMB, LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Remote Car Wash Manager provides chemical monitoring and inventory management services for car wash facilities, including:

• Real-time chemical usage monitoring
• Inventory tracking and management
• Alert notifications via email and SMS
• Analytics and reporting tools
• Multi-location management

3. Account Registration

To use our Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

4. SMS/Text Message Terms

4.1 Consent to Receive SMS

By providing your phone number and enabling SMS alerts, you expressly consent to receive automated text messages from MBMB, LLC at the phone number provided. This consent is not a condition of purchase.

4.2 Types of Messages

SMS messages may include:

• Chemical level alerts (low barrel warnings, critical levels)
• Usage deviation notifications
• System status updates
• Account notifications

4.3 Message Frequency and Costs

Message frequency varies based on your settings and system activity. Message and data rates may apply. Check with your carrier for details.

4.4 Opting Out

You may opt out of SMS messages at any time by:

• Texting STOP to any message

• Updating preferences in your dashboard

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose

6. Intellectual Property

The Service and its original content, features, and functionality are owned by MBMB, LLC and are protected by international copyright, trademark, and other intellectual property laws.

7. Hardware and Sensors

Any hardware or sensors provided as part of the Service remain the property of MBMB, LLC unless otherwise agreed in writing. You are responsible for proper installation and maintenance of equipment at your facilities.

8. Data Ownership

You retain ownership of your data. By using the Service, you grant us a license to use your data solely for providing and improving the Service. See our Privacy Policy for details on data handling.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features with reasonable notice when possible.

10. Payment Terms

Subscription fees are billed according to your selected plan. You agree to provide accurate billing information and authorize us to charge your payment method for recurring fees.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MBMB, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

13. Indemnification

You agree to indemnify and hold harmless MBMB, LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Termination

We may terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately.

15. Governing Law

These Terms shall be governed by the laws of the State of Alaska without regard to conflict of law provisions.

16. Dispute Resolution

Any disputes shall be resolved through binding arbitration in Anchorage, Alaska, except for claims that may be brought in small claims court.

17. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in effect.
